How is overtime pay calculated?

Standard overtime (over 40 hours/week) = 1.5* regular hourly rate. Double time (some states/holidays) = 2* regular rate. Example: $20/hour regular → $30/hour overtime (1.5*) or $40/hour double time (2*). Total pay = (40 * regular rate) + (OT hours * OT rate).

Who is eligible for overtime pay?

Non-exempt employees under FLSA (Fair Labor Standards Act) get overtime. Exempt: salaried executives, professionals, administrative earning $35,568+/year ($684/week). Non-exempt: hourly workers, some salaried under threshold. Independent contractors don't get overtime. Check federal and state laws.

What is the overtime rule in my state?

Federal: 1.5* after 40 hours/week. California: 1.5* over 8 hours/day or 40/week, 2* over 12 hours/day or on 7th consecutive day. Some states follow federal only. Check state labor department. Use most favorable law (federal vs state) if different.

Can my employer require mandatory overtime?

Yes, unless union contract or state law prohibits it. Employers can mandate overtime and discipline/fire for refusal (except nursing in some states). However, they MUST pay 1.5* for hours over 40/week. Some professions (healthcare, transport) have hour limits for safety.

How do I calculate overtime if I have multiple pay rates?

Weighted average method: Total earnings / Total hours = blended rate. Use blended rate * 1.5 for OT. Example: 30 hours at $15 ($450) + 10 hours at $20 ($200) = $650/40 hours = $16.25 blended. OT = $16.25 * 1.5 = $24.38/hour.
